    1. SEP evaluation *1

    · One of the SEP evaluation procedure types is selected from following 2 types according to the applicant’s request, and in both types plural evaluators are appointed from among the JSEP Center Regular Members (including Chief Director and Deputy Director).

    – Regular procedure – using evaluation document, consisting of both “Summary of the evaluation” and “Details of the evaluation” / plural evaluators are appointed

    – Simplified procedure – using evaluation document, consisting of “Summary of the evaluation” / at least 1 evaluator is appointed

    The details are as follows:

    (1) In both SEP evaluation procedure types, the evaluators are appointed from among the JSEP Center Regular Members in principle. The evaluators may be also appointed from the persons qualified as attorney at law or patent attorney among the JSEP Center Counsel or External Member, in case JSEP Center Chief Director and Deputy Director are approved.

    (2) One of the evaluators will be the lead evaluator and the rest will be the sub evaluator when the plural evaluators are appointed.

    (3) A JSEP Center Associate Member may be appointed as an assistant for the SEP evaluation.

    (4) The evaluator independence etc. check*2 will be done in the process of evaluator appointment.

    2. SEP Training
    · A JSEP Center Regular Member or an External Expert on SEPs or technical standard establishment will be assigned as a lecturer.

    3. SEP consulting or other business on SEP
    · A JSEP Center Regular Member or an External Expert on SEPs or technical standard establishment will be assigned.

    [note] A JSEP Center Associate Member may be appointed as an assistant for the business of abovementioned 2 or 3.

    Definition of terms
    *1 SEP evaluation
    · The SEP evaluation means to compare a specific patented invention (the patented invention) with one or more specified parts of one or more technical standards (parts covered by the standard), and to determine, on the basis of the comparison result, whether or not the patented invention is essential to the part covered by the standard.

    *2 The evaluator independence etc. check
    · Independence, etc. includes fairness, independence, and neutrality, and is in a neutral position independent from the applicant when performing SEP evaluation, and is in a state of being able to faithfully perform duties in a fair and neutral position.
    · The evaluator independence etc. check means checking the above independence, etc. based on the statement of the evaluator candidate.
    · Details regarding the evaluator independence etc. check, including factors that impede fairness, independence, and neutrality that should be taken into consideration in the evaluator independence check, are separately stipulated in internal regulations.

    Note 3) In the event of an additional business based on the request of the applicant, such as a business trip interview, the applicant will be asked for the additional expenses incurred at JSEP Center, such as transportation expenses.
